These Terms of Service govern your access to and use of the Southern Girl Customs website, online store, products, and services.
Throughout these Terms, “Southern Girl Customs,” “we,” “us,” and “our” refer to Southern Girl Customs. “You” and “your” refer to the customer, website visitor, or person using our services.
By accessing our website, creating an account, uploading artwork, placing an order, or purchasing a product, you agree to these Terms of Service and our Privacy Policy, Shipping Policy, and Return and Refund Policy.
If you do not agree with these Terms, do not use the website or place an order.
1. Eligibility
You must be at least the age of legal majority in your state or have permission from a parent or legal guardian to use this website and purchase our products.
By placing an order, you confirm that:

Product availability, pricing, colors, materials, sizes, and customization options may change without notice.
We may limit product quantities, discontinue products, or refuse an order when reasonably necessary.
3. Product Information
We make reasonable efforts to display product descriptions, dimensions, colors, images, and pricing accurately. However, website displays and photographs may not perfectly represent the finished product.
Colors may vary because of:

Normal manufacturing variations
Exact screen-to-product color matching is not guaranteed unless a specific color-matching service has been agreed upon in writing.
4. Orders and Acceptance
Submitting an order does not automatically mean that the order has been accepted.
We may review, reject, cancel, or limit an order because of:

Suspected fraud

Payment problems

Incomplete information

Unusable artwork

Prohibited or unauthorized content

Shipping restrictions
An order is considered accepted when we begin production, send an acceptance confirmation, or ship the product.
If we cancel a paid order before production because we cannot fulfill it, we will refund the amount paid for the canceled item.
5. Pricing and Payment
Prices are displayed in U.S. dollars unless stated otherwise.
DTF products may be priced at $0.02 per square inch, using the following formula:
Width × Height × $0.02
Prices may change without notice, but changes will not normally affect an order already accepted and paid unless the order contains an obvious pricing or calculation error.
You authorize us and our payment providers to charge the selected payment method for:

Other charges disclosed before checkout
Applicable taxes will be calculated or added as required.
6. Custom and Personalized Orders
Many Southern Girl Customs products are created specifically for each customer. Custom orders may include customer-selected artwork, text, names, dimensions, quantities, garment styles, colors, and other specifications.
Customers are responsible for confirming all order details before checkout, including:

Once production begins, a custom order generally cannot be changed, canceled, returned, or exchanged.

7. Customer Artwork and Files
Customers must submit artwork that complies with our DTF Artwork & File Preparation requirements.
Unless design services are purchased or agreed upon separately, Southern Girl Customs is not responsible for correcting:

Low-resolution artwork

Pixelation

Incorrect dimensions
-
Spelling errors
-
Unwanted backgrounds
-
Stray pixels
-
Rough edges
-
Incorrect colors
-
Mirrored artwork
-
Cropped elements
-
Improper gang-sheet layouts

Other errors contained in submitted files
We may contact you if we identify an obvious problem, but we are not required to inspect or correct every file. Our review does not transfer responsibility for artwork accuracy from the customer.
8. Artwork Ownership and Permission
You retain any ownership rights you legally hold in artwork submitted to Southern Girl Customs.
By uploading or providing artwork, you grant Southern Girl Customs a limited, non-exclusive license to access, store, reproduce, modify as technically necessary, print, and otherwise use the artwork for:

Reviewing the order

Producing the requested products
-
Communicating about file issues
-
Maintaining order and production records
-
Reproducing an authorized replacement or repeat order
-
Resolving disputes or customer-service claims
We will not use customer-owned artwork for unrelated advertising or commercial resale without permission, except where the artwork consists of materials owned or licensed by Southern Girl Customs.
9. Intellectual-Property Responsibility
By submitting artwork, text, logos, photographs, trademarks, characters, or other content, you represent that:

You created or own the content; or
-
You have authorization from the rights holder to reproduce it; and
-
Producing the order will not infringe another person’s copyright, trademark, privacy, publicity, or other rights.
Purchasing or possessing an image does not necessarily include permission to reproduce it commercially.
We may refuse or cancel any order when ownership or authorization is unclear. You are responsible for claims, losses, or expenses resulting from content you submitted without proper permission, to the extent permitted by law.
10. Prohibited Content
You may not upload, request, or use our services to produce content that:

Violates applicable law

Infringes intellectual-property rights

Contains unlawful threats or harassment

Exploits or sexualizes minors

Promotes illegal activity

Contains malicious software or harmful code

Violates another person’s privacy or publicity rights

Is fraudulent or intentionally deceptive

Is otherwise reasonably considered unsafe or unlawful to produce
We reserve the right to decline content or orders that violate these Terms.
11. DTF Gang Sheets and Transfers
Our DTF gang sheets use a fixed width of 22 inches, with available lengths beginning at 12 inches and extending up to 300 inches.
Customers using the Rolling DTF Gang Sheet Builder or uploading a completed gang sheet are responsible for ensuring that:

Designs are correctly sized

Artwork remains inside the canvas
-
Designs do not overlap
-
Adequate cutting space is provided
-
Backgrounds are transparent
-
Quantities are correct
-
Artwork is not mirrored
-
The uploaded dimensions match the purchased size
Gang sheets and transfers are printed using the submitted layout. Unused space, inefficient placement, or customer-created layout errors are not grounds for a refund or complimentary reprint.
12. DTF Application
Customers are responsible for using appropriate equipment and following our DTF Pressing Instructions.
Results may vary depending on:

Time
-
Pressure

Peeling method
-
Garment composition
-
Fabric coatings
-
Dye migration
-
Washing and care
We are not responsible for transfers damaged during customer application or for garments damaged by incorrect pressing, unsuitable materials, improper equipment, or failure to follow the provided instructions.
Customers should test unfamiliar garments and pressing settings before completing a full production run.
13. Proofs and Customer Approval
If Southern Girl Customs provides a digital proof, you are responsible for reviewing:

Names
-
Dates
-
Colors
-
Dimensions
-
Placement

Quantities
-
Overall layout
Approval authorizes production. Errors contained in an approved proof are the customer’s responsibility unless the finished item materially differs from the approved proof because of our production error.
Colors shown in a digital proof remain subject to reasonable screen-to-print variation.
14. Production and Turnaround Times
Production estimates begin after we receive:

Complete payment

Final artwork

Required order information

Proof approval, when applicable
Turnaround times are estimates unless we expressly guarantee a specific date in writing. Weekends, holidays, artwork problems, proof delays, material shortages, order changes, severe weather, equipment issues, and unusually high order volume may affect production.
A requested event date does not become a guaranteed completion or delivery date unless accepted by Southern Girl Customs in writing.
15. Shipping and Delivery
Customers are responsible for providing a complete and accurate shipping address.
Shipping estimates are separate from production time. We are not responsible for carrier delays outside our reasonable control, but we will comply with applicable requirements concerning delayed online orders.
If we cannot ship within a promised timeframe, we will provide notice and, where required, allow you to accept a revised shipment schedule or cancel the unshipped order for a refund.
Risk of loss and responsibility for delivery will be handled according to applicable law and our Shipping Policy.
16. Local Pickup
If local pickup is offered for an order, customers must wait until receiving confirmation that the order is ready.
Pickup availability, instructions, identification requirements, and holding periods may vary. Do not arrive for pickup before receiving confirmation.
17. Returns, Refunds, and Cancellations
Because custom products are made for a specific customer, most purchases are final sale once production begins.
Refunds, replacements, cancellations, and approved returns are governed by our Return and Refund Policy, which is incorporated into these Terms.
Nothing in these Terms limits rights that cannot legally be waived.
18. Customer Accounts
You are responsible for:

Notifying us of suspected unauthorized activity

All activity reasonably associated with your account
We may suspend or terminate an account used for fraud, abuse, prohibited conduct, or violation of these Terms.
19. Reviews and Submitted Content
If you submit a review, testimonial, photograph, comment, or other public-facing content, you grant us permission to display, reproduce, and share that content for business and promotional purposes.
You confirm that the content is truthful, based on your experience, and does not violate another person’s rights.
We may remove content that is unlawful, abusive, misleading, unrelated, or contains private information.
20. Website Ownership
Unless otherwise stated, the website and its original content—including text, graphics, logos, product descriptions, photographs, page layouts, and branding—are owned by or licensed to Southern Girl Customs.
You may not copy, reproduce, distribute, resell, modify, scrape, or commercially exploit website content without prior written permission.

We do not control those third parties and are not responsible for their separate websites, availability, content, security, or privacy practices. Your use of a third-party service may be governed by that provider’s own terms and policies.
23. Errors and Corrections
Website information may occasionally contain typographical errors, inaccurate descriptions, pricing mistakes, or omissions.
We may correct errors, update information, or cancel an affected order. If a paid order is canceled because of our error and cannot be fulfilled, we will refund the amount charged for the canceled item.
24. Disclaimer of Warranties
To the fullest extent permitted by law, the website and services are provided on an “as available” basis.
We do not guarantee that:

Every product will be continuously available

Website colors will exactly match finished products

Customer-submitted artwork will produce a specific result

DTF transfers will work with every garment or pressing device

Third-party shipping services will meet every estimated date
Nothing in this section excludes warranties or protections that cannot legally be excluded.
25. Limitation of Liability
To the fullest extent permitted by law, Southern Girl Customs will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the website, customer artwork, product use, pressing errors, carrier delays, lost profits, lost business, or loss of data.
Where liability cannot be excluded, our total liability related to a claim will not exceed the amount paid for the product directly giving rise to that claim, except where applicable law requires otherwise.
26. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold Southern Girl Customs harmless from claims, liabilities, damages, and reasonable expenses arising from:

Your misuse of the website or products

Artwork or content you submit

Your infringement of another person’s rights

Your unlawful conduct

Your incorrect application or use of DTF transfers
This section does not apply to claims caused solely by Southern Girl Customs’ own unlawful conduct.
27. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Subject to applicable consumer-protection law, legal proceedings relating to these Terms or our services will be brought in a court of competent jurisdiction serving Marion County, Florida.
Before filing a legal claim, both parties are encouraged to attempt to resolve the dispute by contacting each other in good faith.
28. Severability
If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted or removed as necessary. The remaining provisions will continue in effect.
29. No Waiver
Failure to enforce any provision of these Terms does not waive our right to enforce that provision later.
30. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, Return and Refund Policy, and any product-specific terms displayed at checkout, form the agreement between you and Southern Girl Customs concerning the website and your purchase.
31. Changes to These Terms
We may update these Terms periodically to reflect changes in our products, business operations, website features, or legal obligations.
Updated Terms will be posted on this page with a revised effective date. Changes apply prospectively unless otherwise required by law.
